The Minister of Justice Eric Dupond-Moretti unveiled a plan to fight big drug traffickers this Sunday morning, in the columns of the newspaper La Tribune Sunday. France wants to intensify the fight against organized crime: the government will therefore create a dedicated national prosecutor’s office in the fight against organized crime. The minister also announced the creation in the penal code of a crime of “organized criminal association”.
Eric Dupond-Moretti wants in particular to create a status of “repentant”, inspired by Italian justice in his fight against the mafia. In France, he specifies, “legislation in this area already exists but it is far too restrictive and therefore not very effective.”
But how does this system work on the other side of the Alps? The decision to collaborate is made first by a lawyer, or directly with an anti-mafia judge. Start then an interrogation process with the judicial authorities where initial information is provided.
Having become a collaborator of justice, the repentant must meet strict criteria. For example, the law provides early release from prison provided that at least one quarter of the sentence has been served. Since 2001, the law on pentiti sets a maximum deadline of six months for the transmission of decisive information to the police or the courts, failing which they lose their collaborator status.
A protection program is planned for the repentant and his family, which most often requires a change of identity and domicile. He can obtain allowances and aid for social reintegration.
According to the latest data from 2023, Italy has slightly morea thousand repentants and nearly 5,000 of their loved ones live under police protection. The details of the French reform will be presented in October.
