In his indictment, the representative of the public prosecutor clarified that there was no unfair treatment, particularly in comparison with the case of Azoura Fall. He stressed that his chief prosecutor is currently in Brussels and that he has not received any instructions, which excludes any political character in this trial.

This is a self-referral, triggered by Moustapha Diakhaté’s invectives against a group of people.

Concerning the first offense, the prosecution considered that the defendant had crossed the Rubicon by leaving the domain of political adversity to sink into animosity. According to Google Translate, the word “alkou” means “damned”, “condemned to the punishments of hell”, and is therefore pejorative.

The second offense is linked to the breach of public peace. Diakhate’s comments caused an uproar on social networks. Publicly calling one’s fellow human beings damned is an attack on good morals, according to the representative of the prosecution. The latter requested a sentence of one year in prison, including six months, as well as a fine of 300,000 FCFA.
