4 years since the Mountain Law has existed and… the decree has still not been published. It could be for November 1 according to the executive, but nothing has been done yet and the procedure is long. Which could once again exclude the possibility of the first fines this year.

The government is looking for solutions to reduce the deficit and raise money, but it will probably still not be this year that it will be able to find revenue from motorists located in mountain areas. The famous eponymous law, improved in 2021 to make the use of special equipment compulsory in the departments concerned, still does not produce its repressive effects. And for good reason, the decree which provides for the payment of a fine of €135 (without loss of points) in the event of non-compliance with the instructions is not yet in the Official Journal. It is now becoming almost a habit to write on this theme every autumn at the dawn of the entry into force of the period, which runs from November 1 to March 31.

A new year without a PV?

At the start of the winter period in 2022, the Ministry of Transport already explained that no decision had been taken concerning “a decree creating the sanction”. Two years later, twice again since according to our colleagues at TF1, the executive could well be lenient again. If the decree could actually fall on November 1, there remains an “incompressible” period of implementation of sanctions which will notably go through an educational phase to explain to the French that the iron fist has replaced the velvet glove. In other words, by the time things are put in place on the ground, the sanctions may not fall before the end of the period on March 31. And therefore postpone the PVs once again until next year.

The Mountain Law is however permissive: it does not require the presence of winter tires. The simple presence of chains or socks in the trunk of your vehicle is enough to meet the regulations. But as we see every year, this permissiveness has its limits: some motorists find themselves stuck with their summer tires during changing and difficult conditions, forcing them to stop quickly to install the equipment… and blocking all traffic . The areas provided for installing the equipment are not always sufficient to avoid the total paralysis of the roads, which can also occur in the plains during violent and sudden snow episodes.

Ban on certain tires

The little new thing in 2024 is the end of tolerance for four-season tires labeled M+S, which is not a standard but a simple free designation for tire manufacturers. From now on, only all-season tires that have 3PMSF certification will be accepted in the departments concerned. On the other hand, M+S tires will still be authorized everywhere else. This should not change much for affected motorists since most all-season tires are already 3PMSFbut some more basic range erasers did not meet the standard. You will therefore need to carefully check your tire order if you wish to travel in four seasons.
