Mbappé affair: “reasonably suspicious”, hearing expected… the procedure explained by a Swedish lawyer

What can Kylian Mbappé expect from Swedish justice? The Swedish prosecutor’s office confirmed this Tuesday that an investigation into rape had been opened after Kylian Mbappé and his entourage visited Stockholm last week, without ever mentioning the player’s name. For their part, the Swedish media are more incisive in pointing the finger at Kylian Mbappé as “reasonably suspicious”. But what does that mean?

Two levels of suspicion exist in the Swedish justice system: “reasonably suspicious” and “probably suspicious”. The first, the weaker of the two, only exceptionally leads to pre-trial detention, while the second is generally a precondition for detention, according to the prosecution’s website.

“It doesn’t mean much at this stage for French justice. Concretely, this at least means that there is an alleged victim who has filed a complaint. If Kylian Mbappé is reasonably suspicious as the newspapers claim, it is because it is he who is targeted by the complainant. To move on to the next stage, you need a set of clues that make everything suggest that the rape was committed. If we remain at this first stage, it is because we lack evidence, for the moment,” tells us Pernilla Dahlrot Cabouillet, lawyer at the Swedish bar.

An interview before the Swedish police?

But what to expect from the rest of the procedure? “Normally, he will be summoned to be interviewed. It is entirely possible that he will do this remotely with the French or Spanish justice system which will simply ask the questions transmitted by the Swedish police. He is not at all obliged to go there. Based on this hearing and the evidence, the case can be dismissed. Otherwise, he may be summoned this time to Sweden for a new hearing. If he does not appear at that time, there may be a European arrest warrant, as for any litigant,” continues Me Dahlrot Cabouillet.

According to local newspaper Aftonbladet, police received the complaint this Saturday, after the woman received treatment. The incident reportedly took place on Thursday October 10 at a city center hotel. Black pants, a top and briefs were seized by police, according to new information published by Expressen on Tuesday.

“Rape cases are taken very seriously in Sweden. Since 2018 and the MeToo movement, new legislation has been in place. If we have not clearly ascertained the consent of the person verbally or by appropriate gestures, if the person is under alcohol or anything else, this is considered rape and there may be conviction,” concludes the lawyer. . Now let’s see what the first elements of the investigation will yield.
