The CG endorses the principle of “silence of the administration as agreement”

The Governing Council adopted, on Thursday, three draft decrees relating to administrative decisions, taking into account the comments raised.

Presented by the Minister Delegate, responsible for Digital Transition and Administration Reform, Amal El Fallah Seghrouchni, the first concerns draft decree no. 2.24.522 modifying and supplementing decree no. 2.22.385 of May 8 2023 establishing the list of administrative decisions necessary for the implementation of investment projects, the processing time for related requests of which does not exceed 30 days, underlines a press release from the government spokesperson.

This project is part of the updating of the administrative decisions included in the annex of the aforementioned decree n°2.22.385, namely the administrative decisions necessary for the realization of investment projects, including the processing time of related requests does not exceed 30 days.

The said project stipulates the taking into account of the provisions of Law No. 83.21 on regional multi-service companies and the regulatory texts relating to its application, with regard to administrative decisions relating to the National Office of Electricity and Water Potable (Electricity Sector), included in the annex to Decree No. 2.22.385, as amended and supplemented by this Decree.

The second concerns draft decree no. 2.24.523 modifying and supplementing decree no. 2.22.386 of May 8, 2023 establishing the list of administrative decisions whose processing requires the extension of the legal deadline for their issuance in order to carry out a technical expertise or a public inquiry.

This project is part of the updating of the decisions listed in the annex to the aforementioned decree n°2.22.386, the processing of which requires the extension of the legal deadline for their issuance in order to carry out a technical expertise or a public inquiry.

The Government Council also adopted draft decree no. 2.24.524 modifying and supplementing decree no. 2.22.387 of May 8, 2023 defining the list of administrative acts for which the silence of the administration constitutes agreement after expiration of the deadline processing requests.

This project aims to update the administrative decisions appearing in the annex to the aforementioned Decree No. 2.22.387, defining the list of administrative acts for which the silence of the administration constitutes agreement after expiry of the deadline for processing requests.
