The President of the Constitutional Court, Mohamed Amine Benabdellah, called, Wednesday in Rabat, to encourage the culture of recourse to the Constitutional Court “in order to bring the laws into conformity with the spirit of the Constitution, so as to guarantee the rights and the freedoms of all.
Speaking during a conference at the Faculty of Legal, Economic and Social Sciences of Rabat – Agdal under the theme “Constitutional control: origins, evolution and perspectives”, the president of the CC indicated that the number of appeals addressed at the Constitutional Court (former Constitutional Council) “has not exceeded 19 until the present day”. In this sense, he stressed the need to break with the idea according to which recourse to the Constitutional Court or to justice can only take place in the event of a dispute, adding that the mission of the constitutional judge consists of adapting the laws in the spirit of the Constitution, thus guaranteeing the protection of rights and freedoms.
Benabdellah also emphasized the importance of the role of the constitutional judge, insisting on the need to consolidate the “dialogue between the university and justice” and to promote the exchange of ideas and case law. He considered it necessary to ensure the promotion of a “Moroccan school of constitutional law”, while remaining open to international experiences in the matter.
