Legal leave may be postponed to 2025, under certain conditions

Por the first time, legal leave can be postponed until next year, for employees who are unable to take it all before the end of the year, wrote L’Echo this weekend. Please note, not all workers will be able to postpone their days off.

Before 1is January 2024, all legal leave had to be taken within the year. Otherwise, the employer had to pay him for the days of leave not taken. Only extra-legal leave days could be carried over to the following year, if companies authorized it.

This year the rules have changed. In certain cases, employees will be able to postpone their days within 24 months following the end of the year: they must have been unable to take all of their leave due to accident or illness, maternity leave, prophylactic leave, paternity leave, adoption leave, foster parental leave or for reception missions. In the case of a long-term illness, the worker could theoretically postpone the entire 20 days of legal leave.

Payment for postponed vacation days must take place on December 31 of the year, so it is an advance on salary, explains the CSC.

The impossibility of taking days off must be understood in the strict sense of the term: for example, if a worker wishes to return to work in mid-December after a thematic leave or a long-term absence, he will first have to take their legal days off before being able to return to work.
