Supreme Court: Is the President of the United States on the verge of becoming “an all-powerful king above the law”?

The United States Supreme Court has just vigorously shaken up the legal knot surrounding former President and Republican candidate for the White House Donald Trump. In a ruling handed down on Monday that has American editorialists torn apart, the country’s highest court—dominated by conservative judges—has largely granted, through still unclear nuances, his request for immunity, and thereby redefined the legal protection enjoyed by the presidential office. “A gift of inestimable value to Donald Trump and all future presidents who intend to violate the law and their oath to the Constitution,” begins the editorial board of the New York Timesas Donald Trump faces numerous lawsuits, including one alleging his involvement in the January 6, 2021, storming of the Capitol.

In its decision, the Court grants absolute immunity for the official acts of a president. By this, we mean those arising directly from the prerogatives granted to this office by law and the Constitution. But it also invoked a “presumption of immunity” for unofficial acts, that is, informal acts that do not fall within the presidential function, but which are exercised within the framework of his daily activity. A breach that could have abysmal consequences, a part of the American press is upset.
