If the conclusions of the public rapporteur are followed, the body will reject the request from the channel of host Cyril Hanouna, considering that it is not admissible.
Faced with the C8 channel which is contesting the probable shutdown of its TNT frequency at the end of February, the public rapporteur of the Council of State estimated on Friday that it was too early for such an appeal, the selection by the audiovisual regulator n 'being not definitive. The Council of State, the highest administrative court, will render its decision in the coming week.
If the conclusions of the public rapporteur are followed, the body will reject the request from C8, channel of host Cyril Hanouna, considering that it is not admissible since it arrives before the final decision of the Arcom expected at the beginning December. “The case law is firmly established” for around thirty years, justified the public rapporteur, who says the law.
Owned by the Canal+ group, C8 may subsequently challenge the final selection by the regulatory authority. The publication of the Arcom should take place at the beginning of December, after the conclusion of agreements with the new frequency holders, chosen in July.
C8 launched a petition at the end of last week to request its continuation, which gathered nearly 700,000 signatures.
For the reallocation of 15 TV frequencies in 2025, a pre-selection by Arcom was revealed at the end of July in a press release. The independent regulatory authority ruled out the renewal of NRJ12 and C8, whose lease expires at the end of February, and did not retain the radical left web television Le Média. “If we are not chosen, we are excluded” and already “the consequences are more than significant for C8”argued the channel's lawyer, Me Emmanuel Piwnica, at the hearing on Friday. NRJ12 and Le Média also contacted the Council of State and made the same arguments.
