The PS assures that Luc Frémal, candidate on the list of Mayor Emir Kir and outgoing municipal councilor, signed two acts of presentation, one for the LB and the other for the Fouad Ahidar Team, which is formally prohibited. In fact, the new electoral code specifies that “the outgoing voter or councilor cannot sign more than one act of presentation of candidates for the same election. The outgoing voter or councilor who contravenes this ban is liable to a prison sentence of eight to fifteen days and a fine of 130 to 1,000 euros.”
In addition to the illegal nature of the thing, “this act shows that Team Fouad Ahidar will be in some way indebted to the Mayor’s list,” insists Philippe Boïketé (head of the PS list) who demands that the two lists be excluded from the elections.
“I forgot about the ban”
When contacted, the head of the Team Ahidar list, Irbahim Dankus, assured that he had gone through the process of obtaining 100 signatures from residents. “We contacted the 180 people who had signed for us in October and asked them to sign again. It was a lot of work in a short time. We don’t get along at all with the LB. I was even of those who appealed against the first elections and who denounced irregularities on their part.”
A version which diverges from that of Luc Frémal: “Someone actually came to ask me to sign for the Ahidar list. As a Democrat, it was normal to let a list participate which, in addition, had its signatures for the last elections. But the rule had completely escaped me. I had forgotten the ban on signing two different presentation documents. We realized this when the lists were submitted. But my signature was finally accepted.”
Fouad Ahidar clarifies the situation. “We collected more than 150 signatures in October. But we couldn’t reuse them for February. A new document was needed. We therefore recalled those who had signed and new ones also signed. Except that we had to check that they were indeed registered with the municipality for the signatures to be valid. When in doubt, outgoing councilors were also asked to sign, for security. On the day of submission, we were left with the 100 signatures and the two signatures which were supposed to be, at the beginning, those of a PS and an Ecolo, but that did not happen.”

On the side of the outgoing mayor, we assure that “Mr. Frémal, perhaps distracted, above all wanted to perform a democratic act, symbol of the good health of local democracy, by allowing, at the last minute, a list to be able to participate in the elections as in October. This signature in no way affects the regularity of the application forms. This only concerns the advisor who signed (and which is therefore exposed to sanctions). In addition, the main office responsible for receiving deposits did not receive any objections within the dates provided for this purpose when everyone could do so.”
The PS assures that, this Sunday evening, the presentation of Team Ahidar was not shown to them. “This Thursday, we will see the final validation of the lists, warns Philippe Boïketé and we will see if the justice of the peace validates the two lists.”
