Placed Tuesday January 7 in an administrative detention center (CRA) in Nîmes, the 59-year-old influencer was arrested in , after a video posted on TikToK calling for violence. His words – a “call for torture” targeting “an opponent of the current regime in Algeria” – justified, according to the prefect of Hérault, François-Xavier Lauch, his expulsion and the withdrawal of his residence permit. The man was placed in the evening at the CRA in Mesnil-Amelot (Seine-et-), northeast of Paris, said the Minister of the Interior.

Back in France after being sent back to Paris, “Doualemn” should for the moment remain in an administrative detention center. Now in an irregular situation, since his residence permit has been withdrawn, he could quickly be subject to an obligation to leave French territory (OQTF).

Detention of maximum 90 days

This administrative decision is decided by the prefect of a department (or the police headquarters in Paris). An individual subject to an OQTF normally has 30 days to leave French territory on their own. During this period, the prefect may require the individual to report up to 3 times a week to the prefecture, to a police station or gendarmerie brigade, specifies the Public Service website. At the end of the 30-day period, the individual may be placed under house arrest or placed in an administrative detention center if he is still in France and he receives a ban on returning to France (IRTF). This period may, however, be extended. “OQTF procedures provide for a maximum period of 90 days for placements in CRA, extendable up to four times,” explained to The Dispatch Aurélien Martini, deputy general secretary of the Union of Magistrates, last September.

And after?

But without the possibility of sending the individual under OQTF back to their country of origin, it is difficult to determine what might happen next. Because to expel an individual, you need a consular pass. The execution rate of these administrative measures is around 10%. “The execution of OQTFs relies largely on the identification of people but above all on the agreement of the source country to be able to take back its national,” explained LR senator from Rhône François-Noël Buffet to BFMTV last May.

According to Aurélien Martini, “countries like Morocco, Algeria or Tunisia […] slow down the procedures.” “If these countries do not issue the passes, we can vote on all the texts imaginable in France, we will not be able to send people back to their country of origin, and after 90 days, we will get stuck,” he explains.

The maximum duration of detention in CRA is 90 days (210 days for terrorist activities). In France, these centers have around 2,000 places. They can therefore quickly find themselves saturated.

While he has currently neither been tried nor convicted, the “Doualemn” influencer could therefore be released at the end of the maximum detention period in the CRA and without the possibility of deportation to Algeria.
