Zero points for the harassing student. THE administrative court of Paris confirmed the legality of the temporary exclusion of a student from La Sorbonne, who had “harassed” one of his classmates who aroused a certain “excitement” in him.
Excluded nine months from university
On May 31, 2023, the disciplinary committee of Paris 1 Panthéon-Sorbonne University thus excluded for nine months this student enrolled in the 2022-2023 academic year in the first year of a master's degree in “general public law”. This sanction was posted in the establishment, but also published on the university intranet “in an anonymous manner”.
The university actually criticized him for his “oppressive and repeated behaviors” towards a classmate: he had explained to his victim that he was “excited by her presence” and had offered to “surprise” her “from the start” “by saying boo”… “The same request was also addressed to other young women in the promotion who transmitted their testimony,” notes in this regard the Paris administrative court in a judgment dated October 29, 2024, which has just been made public.
“In addition, MX told Ms. This request was not respected by MX, who approached her again in November 2022, which required […] the intervention of comrades. » The young woman had also told the applicant of the “fear” he aroused in her.
Facts which harmed the victim’s “successful studies”
The first year public law student had again “stared” at his classmate on February 10, 2023 “to the point of justifying that, once again, a classmate intervened”. A “new meeting” also took place subsequently “outside” the premises of the Sorbonne, continues the Paris administrative court.
“Ms. “The facts […] are corroborated by the consistent testimonies of several students, attesting to the voluntary nature of MX's approach to contact Ms. This interaction only stopped with the threat of contacting the police. »
“MX admits to having made “advances” to Ms. X. on October 19 and December 14, 2022, […] refutes the idea of remarks with a sexual connotation by noting that he “on at most one occasion” indicated to Mrs. “He notes that the remarks which led to a decree […] ban on access to premises is taken […] only concerned the formulation of an enjoyment not with regard to the “crying” but to the “sobs” of Mrs.
Under these conditions, and “notwithstanding the health circumstances specific to the situation of the person concerned”, his nine-month exclusion was not “disproportionate”, concluded the Paris administrative court.
