Me Moussa Diop is against the dismissal of Mayor Barthélemy Dias. The president of the Generational Alternative party (Ag/Jotna) gives the reasons for his position. Speaking about the request from the Minister of Justice placed on the table of the National Assembly, Me Moussa Diop maintains that this letter does not have “legal value to remove Barthélemy Dias from the National Assembly”.
He claims that the President of the National Assembly, El Malick Ndiaye, “should not have carried out” this request. “This is what Article 198 provides, I say by interpretation, but textually. The President of Parliament should not have and does not even have the authority to refer the matter to the Constitutional Council.
Only the Constitutional Council, the Office of the National Assembly, a group of deputies in accordance with the Internal Regulations of the National Assembly or the President of the Republic can refer the matter. Final point.
The name of the President of the National Assembly does not appear there. I think that on this point, the Constitutional Council will decide,” adds Me Diop.
The latter notes that article 198 of the Electoral Code says: “The forfeiture provided for by article Lo.162 of this code is noted by the Constitutional Council at the request of the Office of the National Assembly, of a group of deputies , in accordance with the Internal Regulations of the National Assembly, or of the President of the Republic. In addition, in the event of a final conviction after the election, the forfeiture is noted, in the same manner, at the request of the Public Prosecutor's Office.”
