The jurors of the Assize Court of Seine-et-Marne, in Melun, will delve into the closed doors of a family from Provins. From this Thursday and for two days, a young man appears before them, for willful violence resulting in the death without intention of causing it, on a minor under fifteen years old by an ascendant. Behind these words: the drama of shaken babies. The accused, placed in pre-trial detention for nine months, will be free at the hearing. He faces a sentence of 30 years in prison.
The death of the little girl, which dates back to September 23, 2017, occurred at Necker hospital in Paris, where she had been admitted. Born premature four months earlier, the child was monitored at the Provins hospital center. It was during a scheduled visit that a pediatrician, alerted by the infant's condition, decided to have him undergo more in-depth examinations.
A CT scan detected the presence of an acute subdural hematoma (accumulation of blood creating pressure on the brain). Hence his transport to the Parisian hospital specializing in the care of sick children. The baby would die the next day.
Bilateral retinal hemorrhages: one of the shaken baby symptoms was there. An investigation was then entrusted to the former Departmental Security, to understand under what conditions the little girl could have been mistreated. At the time, the father was only 19 years old. He had met his partner three years earlier. Investigators dissected the weeks leading up to the death.
The accused – described as immature – admitted to having shaken his baby one evening because he was crying a lot. Asking him to shut up. The Assize Court will have to determine whether he made a single gesture of irritation or whether it happened several times. Every year, between 400 and 500 infants are violently tossed back and forth by an adult who can no longer stand their cries. A very serious action which causes the death of 10% of these babies and causes lifelong consequences for 75% of survivors.
