Additional information: You lend your vehicle to someone, the case law changes
It’s a classic in car insurance. A story like one we often encounter. For some reason of your own, you decide to pass the wheel to a friend.
With full knowledge of the facts, you hand over the wheel to this driver, who nevertheless does not have a driving license.
« Until now, in the event of an accident, insurance companies decided not to cover you, arguing that you were aware of the driver's lack of driving license. The guarantee fund did not cover compensation in this specific case either. » explains Master Jean-Baptiste Le Dall.
« From now on, the insured passenger victim can be compensated, even in the event that he passes the wheel of his vehicle to a person who does not hold a driving license. A small detail that can have huge consequences. In the event of an accident, medical costs to compensate the victim(s) can reach several hundred thousand euros. » specifies Maître Jean-Baptiste Le Dall.
