The administrative court of Caen put an end to the emerging dispute between a printer from Condé-en-Normandie (Calvados) and theadministration fiscale after the second refused to the first “gas/electricity aid for companies that consume large amounts of energy” for the first half of 2023.
An amount of €44,000
Corlet Imprimeur – located on rue Maximilien-Vox, in the industrial zone of Condé-en-Normandy– had taken legal action on April 19, 2024 after being refused on February 21, 2024: the request presented a certain challenge since the aid concerned an amount of nearly €44,000… The company requested in passing 2 000 € additional to the State for its legal costs.
On August 2, 2024, the departmental directorate of public finances (DDFIP) finally informed the administrative court of Caen that he could order a “dismissal of proceedings” in this case: the requested subsidy was finally “granted to the applicant company”, the administration indicated.
Payment of a sum of €1,000
The printer from Condé-en-Normandie did not withdraw: he told the judges to “maintain his request” to obtain at least reimbursement of his legal fees, up to “€1,500”.
-“Subsequent to the submission of the request, the General Directorate of Public Finances, by a decision of May 24, 2024, granted the requesting company the requested aid,” notes the Caen administrative court in a judgment dated December 9, 2024 which has just been made public. “As a result, the conclusions for the purposes of cancellation and payment presented by the company […] have become irrelevant. »
But, “in the circumstances of the case”, the judges consider that there is reason to “place the responsibility of the State” with the payment of a sum of “€1,000” for the legal costs of the printer.
