The deputy for Brest rural (Finistère), Didier Le Gac (Renaissance) shares the concerns expressed by local elected officials in Finistère on the legal uncertainty surrounding the question of illegal taking of interests and the abuses caused.
“Limit the criminal risk”
In a press release, he recalls that “under the leadership of Françoise Gatel, current Minister Delegate in charge of Rurality, Commerce and Crafts, a bill creating and improving the status of local elected official was voted on at first reading by the senators in March. This text tended to better define the scope of moral interest in order to limit the criminal risk linked to the offense of illegal taking of interests. It excluded public interests from the interests likely to constitute the offense, considering that the criminal liability of an elected official cannot be incurred due to the defense of such an interest. »
Before the recent motion of censure which overthrew the Government, this text was on the agenda of the National Assembly, for the month of January 2025. The MP will plead with the new government so that the bill – already adopted in the Senate – is quickly included on the agenda of the National Assembly, and definitively voted on as quickly as possible.
