Thursday, December 19, the Carcassonne judicial court sentenced a defendant to eight months of home detention with an electronic bracelet for driving without a driving license and without insurance. He had already been sentenced for similar offenses in 2023.
“How do we get out of such a downward spiral?” This is the question posed by the defendant of the day to the Carcassonne judicial court. The latter appeared this Thursday, December 19, to answer for the following alleged facts: “Driving without a driving license and without insurance”. The thirty-year-old is in a state of legal recidivism since he has already been sentenced in 2023 for similar acts.
This time, the offense was committed on May 29, in the town of Pezens. At the end of the afternoon, the police carried out a simple check. In view of the situation, the driver was quickly arrested and then placed in police custody. “It was not my vehicle but that of my ex-partner”he insisted to President Marjorie Lacassagne-Taveau. “At the time of your arrest, the car you were driving had not been insured for two years. Furthermore, this is not the first time that you have appeared before this court. We see you often”he was told.

“The removal of the shoes should have taken place just a few days after his arrest”noted prosecutor Géraldine Labialle at the time of her requisitions. “The defendant had already been on probation for two years. He claims to have not been sufficiently attentive to his lack of insurance but that does not hold. We are talking about a man who has worked in a garage for years.” The prosecution continued by specifying that the vehicle papers were certainly not in his name but he mainly used them. “No more sentence adjustments for this profile. I ask that the car be confiscated, one year in prison and €500 in fines”indicated the prosecutor.
“I would like someone to provide me with proof of economic ownership of my client’s automobile”replied Me Anne Matteo to the defense. The latter also supported the fact that her client was repairing the vehicle at the time of the incident and that he reported himself on his own initiative when the police approached him. “I would like to get my license but I can’t afford it”the defendant told the court.
Finally, he was sentenced to eight months of house arrest with an electronic bracelet, €500 for lack of insurance and confiscation of the car.
