Thanks to social networks, a 69-year-old Aveyron resident came into contact with a 15-year-old Tarn-et-Garon resident. Two physical meetings were organized and each time sexual acts took place. Acts agreed in exchange for a few dozen euros and a cell phone. Facts qualified as resorting to prostitution of a minor and for which the sixty-year-old was convicted.
At the end of October, a father contacted the gendarmerie to alert them that an adult man had allegedly had sexual relations with his 15-year-old son. Studying the young man’s phone allows investigators to access an exchange of impressive messages between the teenager and a 69-year-old from Aveyron. The latter is married and is even the father of 2 children… and grandfather of 4 grandchildren.
The gendarmes’ investigation revealed that the duo met twice, in Caussade and Septfonds, and that each time, sexual acts took place. In particular, several blowjobs are mentioned, sometimes in the defendant’s car, sometimes in public toilets.
Quickly, the young man’s age came to occupy the center of the debates. “He told me that he was 20 years old, defends the accused. He always lied to me about his age, continues the Aveyronnais. He was very enterprising, provocative. When we saw each other, he told me said he was 14 and a half years old, when he was 15 and a half years old”, he says, in a surprising maneuver to clear himself. I only found out his age at the last moment.
“14, 15, 16 or 17 years old, we’re not going to quibble, he was a minor,” says the president of the audience. “So at the second meeting, you knew he was a minor?” she asks. . “Yes, but he softened me with his situation. He told me that his parents had money problems,” he replies.
Nearly 4,000 text messages exchanged between the grandfather and the teenager
Because in addition to having a relationship with a minor, the defendant is accused of having paid for these sexual relations. “I refused to give money,” he lies. The nearly 4,000 messages exchanged prove that the grandfather gave the young boy money, as well as an iPhone. Counterparts which justify the qualification of recourse to prostitution. And the president read some of the text messages sent by the sixty-year-old: “You will get money in exchange”, “You have already had 20 euros for doing nothing”, “OK for money each time but you must be more grateful” .
By way of explanation, the defendant tries to make the magistrates understand that he is an “altruistic” man, who is not necessarily “looking for sexual relations”, but who wants to meet “new people”. Or who wanted to help the boy “buy sneakers”… Enough to make the prosecutor jump, who in turn quotes one of the sixty-year-old’s correspondence: “I really enjoy sucking you off. I would like to be your suggestar daddy1 but there will be a quid pro quo.”
For the prosecutor, the man should be sentenced to 14 months in prison, 4 of which will be suspended. He also requests that contact with the teenager be prohibited and that the parents, who filed a civil suit, be compensated. The prosecutor also requires that the sixty-year-old be prohibited from exercising any activity with minors for 10 years, including through association; his registration in the Fijais (File of perpetrators of sexual or violent offenses) and that a fine of €1,000 be imposed on him.
Magistrates go beyond requisitions
The defendant’s lawyer in turn drew out text messages sent by the minor in order to defend her client: “I want a moneyslave2“. “You don’t understand what I want! I want you to be more generous; I would make an effort, but it’s up to you too.” She opposes the filing of a civil suit against the parents whom she considers “defaulting” and pleads that her client has “understood the lesson”.
After deliberation, the magistrates found the defendant guilty and sentenced him to 18 months in prison, 8 of which were suspended for 24 months. His sentence may be placed under an electronic bracelet. He will also have to refrain from coming into contact with the teenager, receive treatment, pay a fine of €2,000, and compensate the parents up to €3,000 (plus €800 for the costs of lawyers). He will also have to follow, at his own expense, an awareness training course against the fight and purchase of sexual acts and will be registered for 10 years with Fijais.
