Thierry Mosca, 65, has qualified for the second round of the legislative elections in the second constituency of Jura. Problem: the National Rally candidate is under guardianship, which normally makes him ineligible, according to the rules that govern these elections.

Will the candidacy be maintained or cancelled? At 65 years old, the candidate of the National Rally, Thierry Mosca, won the first round of the legislative elections in the second constituency of Jura on Sunday June 30.

He won 32.76% of the vote behind the outgoing MP Marie-Christine Dalloz (38.59%), but ahead of the communist candidate Evelyne Ternant (24.75%), who withdrew to block the far right.

The candidate has been under guardianship since a placement by the Departmental Union of Family Associations (UDAF) in November 2023, AFP reported on Monday July 1, confirming information from Le Progrès.

Placement under guardianship is used when a person experiences a deterioration in their mental faculties, preventing them from providing for their own interests. Thierry Mosca was also the subject of proceedings for “undeclared work”, which were dismissed at the beginning of June, due to his “deficient mental state”.

Persons under guardianship or curatorship cannot present their candidacy in a legislative election, according to article LO129. However, “his candidacy was duly registered”, specified the services of the Jura prefecture.

If Thierry Mosca managed to slip through the net, it is because the documents required when submitting an application do not allow one to know whether a candidate is under guardianship or not. It is only in the event of an election that the winning candidate must provide a birth certificate, which sometimes includes this mention.

Alongside article LO129, article LO128 provides that only people “declared ineligible by the administrative judge or by the Council of State” cannot be candidates. This is not the case for the RN candidate, who was therefore able to run. But his potential election could be challenged in court, then invalidated after the vote.

For the moment, neither the National Rally nor he have reacted.
