Particularity of this case, the fifty-year-old is in a state of legal recidivism. He was sentenced to ten years of criminal imprisonment and ten years of socio-judicial supervision with a treatment order for similar acts committed against his two nephews, by the Var Assize Court, on October 15, 2004. He was completed the end of his sentence in the Casabianda penitentiary center until March 26, 2009. Upon his release, he settled permanently in Corsica.
According to the indictment order drawn up by the investigating judge, consulted by us, the facts were denounced by the son of the accused, on May 6, 2022. That day, he presented himself to the gendarmerie of Cervione, accompanied by his mother and his cousin. Heard by investigators, he indicated that he had been the victim of rape while he was staying with his father during the holidays, the parental couple being separated.
The accused admits the facts
At that time, the accused was living in a mobile home, at a campsite located in San Nicolao. The young boy describes a scene where his father performs forced fellatio on him while holding his arms, before asking him to perform the same thing on him, after undressing. The victim refuses and manages to flee towards the beach in order to warn his cousin.
During his hearing by the gendarmes, he also denounced a rape in the family home when he was “six or seven years old”: “His father then forced him to kiss his penis, which he obliged to do,” relates the order of the investigating judge. Placed in police custody, Patrick Poitreau initially disputes the facts before admitting them during his third hearing.
He faces life imprisonment.
During his interrogations before the investigating judge, he maintained his acknowledgment of the facts while specifying that he had no memory of the scene described by his son before May 2022: “The only thing I have to say is that if my son talked about it, then it happened,” asserts the accused before the investigating magistrate.
At the time of the rape, Patrick Poitreau was receiving psychiatric monitoring with medication. Antidepressants that he associated with heavy alcohol consumption.
The medical expertise carried out on the victim attests to post-traumatic stress, suicidal thoughts, significant anger towards his father, a certain lack of confidence and self-esteem as well as mental disorders. mood.
