A 20-year-old man was sentenced, Wednesday November 13, 2024, by the criminal court of Alençon (Orne) for acts of domestic violence in the presence of a minor and violence by an ascendant against a minor.
Violence against his partner and the baby
The events occurred at the couple's home, Longny-les-VillagesSeptember 14, 2024. Around 5 a.m., the 13-month-old baby started crying. “He had a fever because he was teething,” the child’s mother told the judges.
Annoyed, the child's father grabbed him by the ankle and allegedly shook the child “so that he stops crying,” admitted the defendant on the stand. His partner allegedly slapped him to make him let go of the 13-month-old baby.
There would have followed a violent disputeswhere the man allegedly hit his partner several times, with punches and slaps. He then pushed her against the wall.
The gendarmes were alerted a little after 5:15 a.m. Once there, traces of scratches were noted on the back of the man's neck, as well as marks of slaps and blows on the partner.
Existing tensions in the couple
Before the judges, the parents both admitted that there could be tensions between the couple, but that the man had never been violent before.
From this evening came a total incapacity for work not exceeding eight daysfor the spouse as for the baby.
“I was the one who struck first.”
Called before the judges, the man's wife admitted having given the first blow. “I had a reflex. When I saw that he had grabbed my son's ankle, I slapped him,” explains the woman, who considers that the violence was reciprocal.
No complaints was not filed by the partner, who is also not seeking damages.
I want things to go well for my son. I am not afraid of my partner, nor do I want a ban on contact or appearance.
Six months reprieve requested
The public prosecutor requested six months suspended prison sentence for the accused, and also requested a withdrawal of the exercise of parental authorityas well as an awareness course on domestic and family violence. “Grabbing a baby’s ankle is violence. Slapping your partner is violence,” adds the prosecutor.
The Alençon Criminal Court declared the man guilty of the two cases of violence with which he is accused: those against his 13-month-old baby and those against his wife.
The 20-year-old man was sentenced to four months suspended prison sentenceand will have to pay 300 euros to the Tutelary Association of Protected Adults of Orne (ATMPO), who represented the baby during the trial. The exercise of parental authority has, however, not been withdrawn.
