Arrested and placed in a sobering up cell, her license was immediately withdrawn and her vehicle impounded. “The motorist will be summoned for blood alcohol content and endangering the lives of others,” the Val-d’Oise gendarmerie said on Friday, November 8, 2024.
If found guilty of an offence, she risks a fine of 4,500 euros, 2 years of imprisonment, a withdrawal of 6 points from her driving license and a suspension of her license of up to 3 years.
What are the penalties for testing positive for alcohol while driving?
Today, the alcohol level allowed while driving is 0.5 g/l of blood, or 0.25 mg/l of expired air. If a blood alcohol level of between 0.5 g/l and 0.79 g/l of blood is detected following a breathalyzer test or a blood test, this constitutes a fine of 4e class. In this case, the sanctions provided for by the Highway Code are a loss of 6 points on the driving license, possible withdrawal of license and a fixed fine of 135 euros (which can be reduced to 90 euros or increased to 375 euros) . A license suspension of up to 3 years can also be imposed.
On the other hand, if the alcohol level while driving is greater than 0.8 g/l of bloodthis constitutes an offense and the penalties incurred are more severe: a loss of 6 points on the driving license, license retention of up to 72 hours, administrative suspension of the driving license for a maximum of one year.
A criminal offense also brings a motorist before the court which can impose the following sanctions: a fine of 4,500 euros maximum, compulsory participation in a road safety awareness course, 2 years of imprisonment, a ban on driving certain vehicles for a maximum of 5 years, an obligation to drive a vehicle approved with an immobilizer, a suspension of the driving license for a maximum of 3 years or a cancellation of the license.
