In this case, the magistrate will have two possibilities : leave the mother free under judicial supervision or request her placement in pre-trial detention.

As for Santiago's father, aged 23, the spokesperson for the Amsterdam court declared on November 1 that he had opted “for the long procedure” and that “the request for surrender will be processed at a public hearing of the International Legal Assistance Chamber at a later date“.
Several days on the run
As a reminder, the kidnapping alert was triggered in France on the morning of October 22, 2024. The previous evening, a kidnapping was carried out at the maternity ward of the Robert Ballanger hospital in Aulnay-sous-Bois. Santiago, a 17-day-old infant, had then disappeared. A race against time began, the child, born extremely premature, requiring constant medical care.

The arrest, which took place “smoothly”, made it possible to find the baby, whose state of health was judged “reassuring”.
