On December 20, his 6-year-old son was injured in the left shoulder on his pitch in Toulenne, by a gunshot fired by… his 5-year-old nephew. Results: forty-five days of total incapacity for work (ITT) for the child, as well as sleepless nights and days without for the father, monitoring the state of health of his little boy.

An accident

The court agrees: it is indeed an accident. But an accident that could have been avoided. A few days earlier, the defendant had borrowed a hunting rifle from his father-in-law to get rid of rats invading his land. Distracted by a phone call, he placed the weapon against a shed and then got busy with other activities.

On December 20, the cousins ​​were having fun outside when the nephew saw the rifle and wanted to play with it, without imagining that it was a real weapon. Loaded. The shot went off when he did like the grown-ups, pulling the trigger.

The father has nothing to add. He blames himself. Benoît Bernard, the first vice-prosecutor, requires one year in prison including six months of suspended probation with a work obligation, a parental responsibility course and proposes that the firm part be in the form of home detention under surveillance electronic.

“He has already suffered the punishment,” pleads Me Bénédicte Impérial in defense. “He is fully aware of the seriousness of the situation. All she cares about is her son’s health and he is fine. » An expert report was ordered to verify this.

The 30-year-old was convicted for not having respected the internal security code which requires owners of this type of weapon to put them away, so as to make them “immediately unusable”. He was sentenced to a hundred day fine of 30 euros and a parental responsibility period.
