By rejecting, Monday, May 6, 2024, the appeal filed by the Vienne Nature association, the Council of State definitively validated the project of the Anonymous Cooperative Society for Water Management (Scage) of the Dive Bouleure Clain Amont, including the operating permit was granted by the prefects of Vienne and Deux-Sèvres in March 2017.
Thus, 2.18 million cubic meters of water can be stored in six reserves developed and operated in the communes of Chaunay, Saint-Sauvant, Brux, Rom, Payre and Ceaux-en-Couhé, located in the departments of Vienne. and Deux-Sèvres.
The judgments of Poitiers and Bordeaux confirmed
Endorsing the conclusions of its public rapporteur rendered during the hearing of April 4, 2024, the Council of State considers, like the magistrates of the administrative court of Poitiers in 2020 then the administrative court of appeal of Bordeaux in April 2023, that “the investigation had not shown that the creation of these six water reserves would have the effect of degrading the quality of the water bodies”.
The said investigation of the file had indicated that the objective of the substitution reserves “was certainly to increase irrigation volumes” but “that by optimizing the storage of winter rain, we would reduce withdrawals from the natural environment”.
