This Wednesday, October 2, 2024, the Évry-Courcouronnes criminal court tried to understand why the victim, now aged around fifty, found herself in a coma for two and a half months after having a heart attack and head trauma following a violent couple’s argument.

An uncharged tablet at the origin of the argument

It all starts on March 27, 2018, around 9 p.m. The police are called to the couple’s home. The defendant tells them that his partner hit her head and that she is unconscious at the foot of the bed. He also tells them that he is giving her a heart massage because she is no longer breathing.

Very quickly, the firefighters arrived on site. They take direct care of the victim before transferring them to hospital. Meanwhile, the police question the accused to place him in custody.

When questioned, the latter explains that they argued about his tablet which was not charged. He indicates that she was agitated in all directions and that he grabbed her by the feet to make her calm down. The victim then fell out of bed and hit his head on the ground. A version that he also supports at the hearing.

“The police also heard, the victim’s daughteraged 9. She saw and heard you arguing. She also told investigators that she saw you drag her mother out of bed by her feet. His mother fell and her head slammed on the ground,” specifies the president of the Évry-Courcouronnes criminal court.

The victim suffers from significant cognitive impairment

Medical expert says heart attack and victim’s head trauma are linked to the pulling gesture carried out by the accused to get his partner out of bed.

“Madame’s life has been completely turned upside down since that evening. She no longer remembers what happened. She has serious after-effects such as cognitive disorders. She can no longer drive or work, and is under reinforced guardianship. The gentleman did not want all of this, but he is at the origin of it,” argues the lawyer for the civil party.

The public prosecutor also has no doubt about the defendant’s guilt. “The victim’s daughter saw the scene, she clearly said that the man pulled her mother by the feet and she fell to the ground. The gentleman also gives the same version when he calls the firefighters and the police. I require a sentence of 5 years of imprisonmentincluding 3 years with a probationary suspension of two years. »

The decision has been deliberated, it will be rendered November 6, 2024.
