In the event that the septuagenarian is “ permanently unavailable »the case would then be “ sent back »added the magistrate, referring to the suspension of this trial, which began on September 2 and was scheduled to last until December, and its postponement to a later date.

Already excused from following the hearings on Monday 9 and Tuesday 10 September due to intestinal pain, Dominique Pelicot reappeared in his box on Wednesday morning, visibly very weak, before being excused from following the debates again.

At the opening of the hearing on Thursday, the president of the court said that the 71-year-old pensioner had been examined by a doctor who “ confirms the need for a dispensation this Thursday and tomorrow Friday, the implementation of appropriate treatment, with possible hospitalization, and a possible discharge date on Monday.”

“What if Mr. Pelicot is not here on Monday?”had then requested his lawyer, Béatrice Zavarro, who is pleading like the civil parties, for the suspension of the proceedings if he remains absent. “So, it’s a disaster (…), we would be forced to postpone it for another week”President Arata replied, before explaining: “ If he can’t be there until Monday, we can postpone it to Tuesday, the week is flexible. Afterwards, if it was a longer unavailability, we will discuss it again.”.
