The Algerian government published, on Sunday November 17, 2024, a decree in the Official Journal indicating new conditions on marriage in Algeria. Regulations which include specific medical analyzes and examinations and which must apply to all future spouses wishing to marry before a notary or civil registrar.
Indeed, the published text aims to “set the terms and conditions for establishing the medical certificate and the list of examinations and analyzes required before marriage”. The first condition to respect: the medical certificate which involves a medical examination “compulsory prenuptial”.
The objectives of the prenuptial certificate for marriage in Algeria
Making a prenuptial medical certificate compulsory, the government is setting up a medical examination which has three objectives, namely the assessment of the state of health of the future spouses, the detection of pathologies and risk factors and information on the lifestyle, reproductive health and family planning.

The decree also specifies that this examination must be carried out by a “practicing doctor for each of the future spouses through a medical consultation, at the end of which a prenuptial medical certificate is issued to each of them”. In other words, this certificate is essential for the conclusion of the marriage before a civil registrar or a notary.
Before issuing a medical certificate to the spouses, the doctor must carry out a “careful interview looking for family or personal history of chronic pathologies, hereditary diseases or malformations, in particular chromosomal anomalies, genetic diseases and congenital heart diseases” . He will also have to measure everyone's blood pressure, weight and height and give them a complete clinical examination.
Mandatory analyzes and examinations
For the clinical examination, the doctor will carry out biological analyzes including determination of the blood group (A, B, O, Rhesus) and serological examinations for toxoplasmosis, rubella and syphilis. As for the recommended biological examinations, he recommends viral hepatitis B (HBV) serology, viral hepatitis C (HCV) serology and human immunodeficiency virus (HIV) serology.
It should be noted that the doctor can also prescribe other biological examinations in the event of signs or symptoms “that could lead, in particular, to sexually transmitted pathologies”, and to check the health records of the future spouses. Once the future spouses have carried out all the obligatory medical examinations and taken note of the results, they will be able to conclude, or not, the marriage before a notary or a civil registrar.
