Because the victims' fear is that Pierre Palmade will escape justice thanks to his celebrity or too lenient justice. On May 27, 2024, the Melun public prosecutor's office announced that the actor was referred to the criminal court pour “unintentional injuries by driver who deliberately violated a particular duty of care and safety”
Although he risks a fine of 200,000 euros and up to 14 years in prison, the victims' lawyer regrets that he will not be tried for “involuntary manslaughter”. Me Mourad Battikh spoke on RTL this Sunday, November 17, 2024, and this court decision still does not pass. He first gave news of his clients, who “are doing better physically” et “are slowly but surely recovering from their injuries and the shock they suffered”. It is the psychological aspect which seems more complicated.

The dead baby not given enough consideration according to the victims' lawyer
Lawyer Mourad Battikh explains that the difficulty for the victims is mainly psychological: “It is much more complicated to rebuild oneself on this level after this tragedy”. For the woman who was pregnant at the time of the events, the loss of her child “who was going to be born” still affects him just as much. The hardest part for her would be the lack of consideration for his baby: “nothing” for the State.
The qualification for unintentional injury and not homicide is “scandalous” according to the magistrate: “Legally, for there to be a homicide, there must be a living being who is dead. And there, we had a fetus that was going to be born, alive and viable and that couldn't because of the accident. There is a direct causal link between the death of this child and the accident. And legally, we draw no consequences from this”. What's more, the drugs consumed are an aggravating circumstance according to him: “There is an intentional element. When we take a cocktail of drugs for several days, we decide to put ourselves in this state and consume excessively. Ultimately, we decide to take the vehicle and endanger the lives of others.”
