Elon Musk’s social network believes it has satisfied all the requests of the Brazilian justice system, in particular by appointing a legal representative in the country.
The social network The old Twitter has been suspended since August 31 in Latin America’s largest country, where it had around 22 million users.
At issue: the refusal of the platform of American billionaire Elon Musk to delete several far-right accounts accused of spreading false news, but also the fact that it no longer had a legal representative on site.
“Protect freedom of expression within the limits of the law”
Having presented new documents requested by Supreme Court judge Alexandre de Moraes, the company considers having satisfied all the requests of the Brazilian justice system and is demanding the lifting of its suspension, indicated the source close to the matter.
X has undertaken to “protect freedom of expression within the limits of the law” and to respect “the sovereignty of the countries” where he operates, in a message published Thursday on his account dedicated to relations with governments on the platform .
“We believe that access for the Brazilian population to X is essential for a vibrant democracy and we will continue to defend freedom of expression through legal process,” he added in a message in English and in Portuguese.
Fulfill all conditions
X finally recently appointed a legal representative in Brazil. But last Saturday, Judge Moraes ruled that X had still “not duly fulfilled” all the conditions to obtain an end to his ban. He gave him five days to file additional documents.
The judge also ordered X to pay a fine of at least five million reais per day (around 820,000 euros) for violating its suspension on September 18, when the platform became accessible again after a technical maneuver. The social network assured that this was the “involuntary and temporary” consequence of a change of server, without convincing Judge Moraes. The platform was blocked again the next day.
Consulted, the Pinheiro Neto law firm, which represents X in Brazil, did not wish to comment. The Supreme Court said no more, in the name of judicial confidentiality.
Supported by the Brazilian right and far right, Elon Musk described Judge Moraes as an “evil dictator”. The magistrate highlighted the risk that disinformation poses to democracy.
