
The regularity of the resolution filed by Guy Marius Sagna aimed at indictment President Macky Sall poses questions. According to the former deputy Alioune Souare, the internal regulations of the National Assembly do not allow a deputy, taken individually, to file such a proposal. According to him, only the permanent commissions are empowered to introduce resolutions on the agenda, as has article 91 of the internal regulations: “The National Assembly can register, on its agenda, the discussion of the resolutions presented by one of its commissions. »» In the absence of this path, the resolution should not be admissible, except to be brought by the finance committee, in connection with its object.
Alioune Souare compares this situation to that of countries like France or Benin, where the texts deposited by the deputies are systematically transmitted to the competent commissions, promoting greater freedom of parliamentary initiative. For Mr. Souare, this flaw in the procedure could open the way to a legal challenge, relaunching the debate on the limits of parliamentary power in Senegal.
