Sick leave for civil servants: New provisions in force

In a note intended for ministers and senior administrative officials, the Ministry of Digital Transition and Administration Reform explains the new measures taken to strengthen the social protection of civil servants as part of the reforms provided for by Law No. 46.24.

Here are the main points of this new legislation:

  • Conservation of salary rights in the event of long-term illness:

Law No. 46.24, recently amended, introduces provisions improving the social protection of civil servants, in particular by preserving their salary rights in the context of leave for medium or long-term illnesses. It is now possible to better supervise the management of absences for medical reasons, in particular for civil servants suffering from serious illnesses, such as cognitive or neurological disorders.

  • Update of the list of illnesses giving entitlement to sick leave:

The new legal provisions extend the list of illnesses giving entitlement to long-term leave, now including serious neurological conditions requiring prolonged follow-up. Civil servants affected by these illnesses will benefit from continued care, without losing their salary rights or other social benefits.

  • Removal of the sanction of dismissal with suspension of the right to retirement:

The reform also provides for the removal of the sanction of dismissal which was applied to civil servants suspended due to prolonged illness. This sanction prevented the employees concerned from receiving their pension rights and other social benefits.

As of the entry into force of this reform, civil servants will no longer be subject to this penalty and will retain all of their social rights, even in the event of extended sick leave.

These new rules have been in force since August 22, 2024, and all ministries and public administrations are invited to ensure their rigorous application. Instructions have been given for these provisions to be implemented without delay, thereby ensuring better social protection for the civil servants concerned.
