the family hopes that “light will be shed on the circumstances of Delphine’s murder”, according to their lawyer

In an interview with CNEWS, the lawyer for Delphine Jubillar’s family, Me Mourad Battikh, returned to the trial of Cédric Jubillar, which will take place in September 2025 before the Tarn Assize Court.

Accused of having made his wife Delphine disappear in December 2020, Cédric Jubillar, a 37-year-old painter and plasterer, will appear before the Tarn Assize Court, in , between the end of September and October 2025.

The referral to the assizes, first decided in November 2023, was notably delayed by additional information linked to new elements but the additional investigations ultimately changed nothing in the indictment order.

We are talking here about one of the most anticipated trials in this year. Cédric Jubillar, main accused, is indicted for the murder of his wife and has been in detention since June 18, 2021.

The particularity of the file on the disappearance of Delphine Jubillar is that, until now, no body has been found. Furthermore, this case is marked by no confession, no witness, no crime scene, no irrefutable evidence. Moreover, according to Me Alexandre Martin, one of Cédric Jubillar’s three lawyers, this is a trial, the deadline for which was decided during a preparation meeting organized at the Court of Appeal. in November 2024, “where everything is contested”.

However, in this case, Delphine Jubillar’s family can count on the impressive Melunais lawyer, Me Mourad Battikh. This is a face far from being unknown to the general public since he regularly works on “publicized” cases, including the trial of Pierre Palmade, the disappearance of Leslie Hoorelbeke and Kevin Trompat or even the murder of Sihem Belouamia .

The family expects peaceful “debates”

It was in the premises of his firm, located in the 17th arrondissement of near the Champs-Elysées, that the young lawyer received CNEWS. And the man who won the lawyer competition on the first try before taking the oath in 2018 to the Paris bar agreed to answer our many questions surrounding the Jubillar affair.

It took more than four years for a trial to be held in this case. And for Me Mourad Battikh, this trial represents a kind of hope for the family of Delphine Jubillar so that all light can be shed on the mysterious disappearance of the young nurse and mother of two children.

“My clients hope that this trial will finally shed light on the precise circumstances of Delphine’s murder. They also expect that the debates can take place as calmly as possible,” the civil party’s lawyer tells us.

Today, the investigations are almost complete. Nevertheless, and even if Cédric Jubillar has proclaimed his innocence on several occasions, investigators are convinced that the painter-plasterer killed his wife, when she had just announced her intention to divorce. But what would happen if, between now and the trial, a new element was discovered?

According to Me Mourad Battikh, “the investigations are now completed but if a new determining element were to emerge then we would be notified in the same way as the other parties to the case”.

There are nevertheless sufficient elements which would be likely to establish the guilt of Cédric Jubillar

As previously indicated, in this complex case, no body was found, no witnesses came forward and no crime scene was observed. However, Me Mourad Battikh remains confident, believing that “the absence of discovery of Delphine’s body is obviously an argument used to weaken the accusation”.

“There are nevertheless sufficient elements which would be likely to establish the guilt of Cédric Jubillar before an Assize Court, as considered by the Toulouse investigating chamber in its indictment judgment,” recalled the lawyer for the victim’s family.

But could the non-discovery of the body have an impact on the sentence that could be handed down against Cédric Jubillar if he is found guilty? For Me Mourad Battikh, “if Cédric Jubillar were to be found guilty of the acts with which he is accused, the absence of a body should have no consequence on the sentence imposed”.

Also note that on the defense side, the latter should not appeal to the Court of Cassation. She assured, however, that she would persevere in her quest for the release of Cédric Jubillar before the trial, while around ten requests were rejected during the investigation.
