But faced with the death of a man, and even more so of a friend, this entrepreneur from Nice came to seek conviction. This Tuesday, the Nice criminal court found him guilty of concealed work, and his company, of involuntary homicide.
The court chaired by Christian Legay examined this painful case on December 10.
On May 22, 2022, a worker aged in his thirties was crushed to death by a Bobcat, on the site of a villa under construction, in the upscale Mont-Boron district. The bucket installed on the construction machine was heavier than the authorized load.
The Bobcat belonged to a Nice entrepreneur. Not the bucket. It was not he who had installed it, not he who was driving the machine, nor he who had recruited Stefan, this thirty-year-old of Romanian origin. He was not even present on the construction site that day. But he accepted the fact that his name appears on the vehicle’s registration document.
4 months suspended prison sentence
The only defendant at the bar, he could have contested his responsibility, notes his counsel, Me Georges Mendes. But this entrepreneur could not allow the trial to conclude without a guilty party. And this, out of empathy towards the family of the victim, represented by Me Jordan Haddad.
The court followed the prosecution’s requisitions. He sentenced the entrepreneur to 4 months in prison and a fine of 3,000 euros. His company, for its part, was fined 40,000 euros. She must also pay the civil parties nearly 70,000 euros for emotional damage, as well as funeral costs.
