Hunting incident: BFM is surfing on empty ground

Supposedly illegal shooting, a legal weapon and a cruel lack of clarity on a regulation that is nevertheless simple. BFM is riding a wave of interstellar emptiness.

Did a hunter shoot too close to a home this weekend? BFM takes us on a thrilling affair full of twists and turns (no). Let’s discover together how the media constantly pushes the limits of the void.

The offense allegedly occurred last weekend between Pierrevert and in the Alpes-de-Haute-Provence. Residents present at the time of a hunter’s shooting alerted the police, who went to the scene.

When questioned, the hunter defends himself and maintains that his shot was carried out taking into account all safety rules. Obviously, the local residents contest and maintain their position.

Contacted by BFM, the president of the Alpes-de-Haute-Provence hunting federation, wished to remind us of the main rule to respect when hunting near a house, which is to stand with your back to the house at the time of hunting. shot. It is obviously strictly forbidden to shoot in the direction of a house or a road.

The hunter’s rifle was seized and a check was carried out to verify that the weapon was in order. Nothing to report on this side, the weapon was indeed registered with the Weapons Information System (SIA).

What follows is a long crossing of the desert during which BFM ultimately tells you absolutely nothing about the legislation in force (which, in the end, would have been the only useful information in this article).

“It remains to be seen whether an offense was committed during a shooting. Which does not seem obvious given the legislation that exists.”

“The current investigation will also have to look into complex legislation which sometimes differs from one municipality to another depending on municipal decrees. Particularly with regard to the regulatory distance that a hunter must respect from private land.”

Although it may seem complex, the applicable regulations are in reality not that obscure.

In certain departments, it is the Approved Municipal Hunting Associations (ACCA) which are responsible for the management of hunting areas. According to article L422-10 of the Environmental Code, plots located in this famous zone of 150 meters around a home are excluded from the ACCA territory. Members of the association cannot therefore hunt there. On the territories who are not managed in ACCA, the rule is simple: we do not shoot in the direction of roads or homes.

The agreement to hunt in this famous 150 zone (in ACCA) belongs to the owner of the plot. It is therefore possible to hunt near adjacent homes, the important thing being to never shoot in the direction of them.

In conclusion, yet another very popular article on which BFM could have ignored, thus avoiding giving fodder to the anti-hunting people lurking in the area.
