TikTok got one first opening in the USA: the Supreme Court has declared that it will receive a hearing in January to hear the social network’s findings on the constitutionality of federal law that could force it to close in the United States if its Chinese parent company won’t sell it.
The appointment is for January 10th and TikTok with its parent company Bytedance will try to demonstrate that the rule impermissibly limits the freedom of speech in violation of the First Amendment.
The obligation to sell in an April law
The law in question was enacted on last April and has a deadline of January 19th for the sale, so the times are very tight and the future of TikTok in the country it will depend precisely on the speed of the judges.
The high court will also hear the arguments of the creators of content that works with the platform as well as some users.
Security concerns
The reason behind the obligation to sell is due to fears for the safety of American citizens: according to the promoters of the law, users could be spied on from the platform.
The matter is even more complicated because it was the administration of the outgoing president who supported the sale, Joe Bidenwho will then defend the law. On the contrary Donald Trumpafter being a critic of TikTok, seems to have changed his mind during his electoral campaignalso helped by the short video social network, but as it is not yet in office it cannot make its position count.
