Death of Mustafa, struck on a pedestrian crossing in : two years in prison with suspended probation for the driver

After a week of deliberation, the judges of the Senlis Criminal Court found Fatih Y., 39, guilty of involuntary manslaughter and sentenced him to a twenty-four month prison sentence with suspended probation. His driving license was revoked and his vehicle confiscated. He also faces a fine of 300 euros for driving without insurance. A small sum compared to the tens of thousands of euros in damages that he will have to pay to the family of the victim, a 62-year-old man, whom he hit on a pedestrian crossing on rue Gambetta in on May 4, 2023.

The fact of not having insurance does not prevent Fatih Y. from driving fast, too fast given the traffic conditions, since the zone is limited to 30 km/h and his speed will be estimated at around 59 km/h. h. Too quick to see Mustafa D., 62, crossing the street after a bus gave way to him in the bus lane. Undoubtedly hampered by the bus and driving too fast, Fatih Y. cannot avoid the collision with the pedestrian who is thrown 20 m further.

A scene horrified by the victim's wife, who was waiting for her husband in a store, and before which she fainted. Rushed to Creil hospital, the sixty-year-old died from his injuries a few hours later.

At last week's hearing, Fatih Y. apologized twice to Mustafa D.'s family, reminding in passing that he had not shied away from his responsibility by calling for help himself and by remaining there while some witnesses advised him to leave the scene. Mustafa D., described as a pillar of his family and community, was three months away from retiring after a long career as an artisan and trader.
