The opportunity to discuss a crucial point at the end of the year: electric vehicle charging and the benefits-in-kind policy specifically allocated to these vehicles for four years now.
A decree is always possible…
Since the beginning of the week, a multitude of alarming articles have been published on the subject. These articles highlight that the last decree published in 2022 on the issue will end on December 31, 2024, and announce the end of the exemption for charging electric vehicles with benefits in kind. However, to date, there is no information to completely confirm or refute this hypothesis. According to representatives of Urssaf Île-de-France, “it is urgent to wait“.
“Political time is not the same as media time or operational time of a company“, they underlined in front of the automobile fleet managers present during our event, recalling that “the decree which had extended the exemption measure two years ago was only released on December 8, 2022“.
The budgetary texts (Social Security financing bill, PLFSS, and Finance bill for 2025, PLF) are still in the parliamentary shuttle, it is entirely likely that the government will extend the rule currently in force beyond December 31, 2024. This would be done by regulatory means, that is to say by decree published in the Official Journal. Also, for Urssaf, the methods of controlling and calculating a benefit in kind on recharging electric vehicles seem very difficult to implement.
…to be part of an energy transition logic
Remember that since January 1, 2020, company employees can recharge freely and free of charge at their workplace, even for non-professional purposes. The extension of this system, which many organizations in the automobile fleet ecosystem are calling for, seems fit into a certain logicwhile public authorities are exerting unprecedented pressure on companies to accelerate the energy transition of vehicle fleets.
Especially sincea project to reform benefits in kind for thermal vehicles is currently being considered. The current flat rate of 30%, applicable to employees benefiting from the rental of a company vehicle, could be increased. It could rise to 50% or 60%, although rental companies are still trying to convince Bercy that such rates do not reflect personal use of vehicles.
