Côte-d'Or: he cannot take his trash to the collection point, a disabled retiree sentenced

A sick and disabled retiree was condemned for leaving his trash cans in front of his home, even though the garbage trucks no longer pass through his cul-de-sac, reports “Le Bien Public”. He cannot transport his bins to the new collection point.

An 80-year-old man was sentenced to five fines of 200 euros by the police court, for “depositing or abandoning garbage, waste, materials or objects outside authorized locations”. This retiree, sick and disabled, cannot move his waste bins to the new collection point set up by Métropole at the end of his dead end, reports The Public Good.

As our colleagues explain, the garbage collectors' dump truck no longer passes through the street where the octogenarian and his wife live in -lès-Dijon (Côte-d'Or). The metropolis adopted a new regulation in August 2023 according to which the collection vehicle will no longer use dead ends that are too narrow. The aim is to avoid any accident when turning or shifting into reverse.

Stroke and cancer

But for the retiree and his wife, it is impossible to transport the bins to the end of the lane. During the hearing held on November 18, the octogenarian's lawyer recalled that her client had suffered a stroke, cancer and that he suffers from respiratory failure. “The drop-off point is located at an extremely important distance considering its condition, approximately 80 meters,” she pleaded.

Nothing to move the court which went beyond the requisitions of the public prosecutor who had requested fines of 150 euros. The man, who continues to pay the garbage collection tax, has decided to appeal. His lawyer also referred the matter to the administrative court for abuse of power on the part of the metropolis, the regulations of which go against the General Code of Local Authorities.
