Two series of facts brought the defendant to the court of Saint-Nazaire (Loire-Atlantique) on Wednesday November 13, 2024. The first events date back to July 14, 2023.

While a birthday party is taking place in Montoir-de-Bretagne, rue des Flandres, a young person is slightly injured.

The defendant, a resident of Saint-Nazaire, manager of a painting company, remembers:

My wife called me to tell me that someone had touched my daughter. There, she told me that her friend's father had attacked her in the bedroom when he wanted to treat her.

€15,000 stolen

Around 9 p.m., the supposed attacker (no further action was taken after a complaint was filed) was found injured after a fight, with knife marks on his face.

The defendant was absent during the altercation because he had brought his daughter to the hospital. But he is suspected of having participated a few hours later in a burglary at Montoirin's home, while he was still in hospital, and of having vandalized his truck.

A bank card, a telephone, identity papers, work tools and the sum of 15 000 € are stolen from him.

Apartment door burned

A year later, on September 29, 2024, around 11 p.m., the victim saw smoke under his apartment door and called the firefighters. He will be evacuated through the balcony on the second floor.

In the box, the defendant in pre-trial detention since October 9, denies all the facts.

“However, witnesses saw you damage the truck and we found the victim’s credit card at your brother’s house,” explains the president. “He's not my brother, but a namesake », replies the accused.

Concerning the fire, the entrepreneur assures that he did not go to Montoir-de-Bretagne that night. “However, witnesses claim to have seen you,” retorts the president.

“I was at home in Saint-Nazaire with two of my employees.” The latter also came to the stand to support this version of the facts. For his part, the victim explains suffer threats regularly since the events of 2023.

“Determination for revenge”

For the defense lawyer, there is no doubt: “Your wife said that you went up to my client's apartment. The victim's ex-wife also claims to have seen you. And three other direct witnesses corroborate the facts. Based on the events of September 2024, we weave a story with these two employees. But testimonies attest to the presence of the accused at the foot of the building with in his hand, what can be compared to a container.

For the prosecutor, the facts are also fully established and underline the determination of the accused:

Self convinced of the attack on his daughter, to take revenge. A form of resentment intact for acts that went unpunished because they were dismissed without further action. With the fire, you endangered the entire building. Residents were evacuated.

It requires 30 months imprisonment including 15 months suspended sentence and continued detention.

“Dismayed by the lightness of the procedure”

The defendant's lawyer denounces a case that is threadbare.

“There are doubts in this matter, and it is therefore a relaxationwhich must be pronounced.

He also said he was “appalled by the lightness of the procedure. We found a can in my client's cellar. The judicial police officer didn't even look at what was inside, he just wanted a photo. It’s lamentable.”

The court followed the prosecutor's requisitions.
