The jury of the Côtes-d’Armor Assize Court did not follow, this Friday, November 15, 2024, the requisitions of the attorney general who requested the conviction of Gaël Scoubart for violence leading to the death without intention of the give. She had requested 20 years of criminal imprisonment against him, accompanied by a security period of ten years, as well as socio-judicial monitoring of five years upon his release.
At the end of seven hours of deliberation, Gaël Scoubart, aged 32, was found guilty of murder of little Eythan, 3 years old, killed in Guingamp on July 10, 2022. The alteration of the discernment of the father-in-law of this child who died from a violent shaking, mentioned by his lawyers during their pleadings, was not accepted by the court which sentenced him to thirty years of criminal imprisonment.
Mother taken to prison
Lisa Duguet, Eythan’s mother, was prosecuted for deprivation of care and failure to assist a person in danger for not having rescued her child on the evening of the tragedy, was found guilty of these two offenses. As a result of repression, she was sentenced to five years in prison, including one year with a probationary suspension during which she will have to seek treatment and work. A warrant of committal having been issued against her, she was escorted to a remand center.
“Justice has been served”
At the end of this painful week of trial that began on Friday November 8, 2024 at the Saint-Brieuc judicial court, the family of little Eythan said they were relieved by this verdict. “Justice has been done to this little boy,” said their lawyer Bertrand Faure, leaving the courtroom.
Gaël Scoubart’s counsel, including Mr. Thomas Jourdain-Demars, who had pleaded for the acquittal of his client considering that the evidence was insufficient to convict him, have already announced their intention to appeal this judgment.
