She did not spend a single day in prison. However, it is before the Assize Court that this woman, now 47 years old, will appear, Monday, November 12, in the courtroom of the Niort judicial court.
Almost four years ago to the day, in November 2020, this resident of Argenton-l'Église, in Thouarsais, was indicted for the murder of a minor under 15 years of age after the death, a few days earlier, of her newborn. On November 24, 2020, then eight months pregnant, she gave birth alone, in her toilet, the baby dying after falling into the bowl.
Father accused of raping his daughter
At the end of the investigation, the charge of murder was finally reclassified: the investigating judge did not accept the intention to kill and finally prosecuted the forty-year-old for neglect of a minor under fifteen followed by death.
Not enough to prevent him, however, from going to court. “She is very apprehensive about this trial, but she is preparing for it and is ready to answer questions,” assures Me Ambroise Garlopeau, lawyer from Deux-Sévrier who will defend this mother of two boys, alcoholic at the time of the facts. “She was in a very fragile situation, but today she is better, she has started working again”specifies his lawyer.
The latter, however, does not know whether the accused will be present alone at her trial or whether members of her family will be present to support her during the three days of hearing. She faces up to thirty years of criminal imprisonment.
The court will then meet around an appeal case, after the conviction on November 15, 2023 of a 28-year-old man for attempted murder by the Vendée Assize Court.
Finally, it is for acts of incestuous rape of a minor that a 56-year-old man will face judges and citizen juries. He is accused of having committed rape on his own daughter between 2015 and 2021 in Bocage Bressuirais, when she was only 7 years old at the start of the incriminated period. She is 16 years old today.
If the accused appeared before the Assize Court and not in the departmental criminal court as is the case for rape cases, it is because he is being tried as a repeat offender: in 2007, he was convicted for sexual assault on his niece but also for possession of child pornography images.
He faces up to thirty years of criminal imprisonment. He will be defended by Me Laurent Lesage, of the Poitiers bar. On the side of the civil parties, it is the victim's mother, still a minor, who will represent her, with lawyer Patricia Coutand. The latter will request a closed session for this trial.
