Didier Migaud wants to “relax” “the minority excuse for those over 16” in “the most serious cases”.
The minority excuse is a principle which dates back to a 1945 ordinance, included in the penal code, according to which a minor must be punished less severely than an adult. It has only been lifted twice by the courts since 1945, for particularly serious crimes.
The possibility of an “immediate appearance”, currently impossible, should also now be possible for those over 16 in the event of involvement in drug trafficking.
These changes will have to go through a new law.
