News – REGULATIONS ON THE USE OF FIRE – illiwap news from Pourcharesses Town Hall

The autumn season corresponds to that of heap fires and burning, so for your good information, we remind you the general provisions that apply
  • be covered by an insurance contract for repair of damage that may be caused by burning;
  • the use of fire is prohibited all year round, in established winds equal to or greater than 25 km/h and in the event of an exceptional fire risk determined by prefectural decree
  • do not burn at night and completely extinguish the embers before leaving the premises
  • ensure that, in accordance with article L 411-1 of the environmental code, protected species or their habitat are not destroyed; for this purpose, exit routes must be left for wild animals;
  • it is forbidden to light fires on peat bogs (provide for the installation of firebreaks to protect them); other wet areas also deserve particular attention through a suitable system (common fires by tasks or by parquet floors);
  • vensure the preservation of wetlands and rocky areas; in the territory of the Cévennes National Park, agents will provide, upon request, the information necessary to respect biological issues and may propose contracts to take these issues into account;
  • preserve the vegetation along the edge of a river or any watercourse to a depth of at least 3 meters from the bank.

Heap fires (incineration of cut plants)

From October 1 to January 15the period is called “free”, because it does not require a declaration to the sub-prefecture.
Generally speaking, il is necessary:

  • to have in the immediate vicinity a sufficient water reserve and suitable means of control for the use of extinguishing water;
  • to ensure that the pile to be burned is of a determined volume so that when ignited, it presents no risk of propagation by radiation to adjacent plots and spaces, to allow extinction at any time .
  • Clear the area around the area to be incinerated to avoid any spread to neighboring plants.

Ecobuages (standing plants – low and shrubby vegetation)

From September 16 to February 15the period is called “free”, because it does not require a declaration to the sub-prefecture.
Generally speaking, il is necessary:

  • to previously carry out the necessary arrangements on the perimeter of the area to be burned so that the fire does not spread outside it and does not cause damage to third parties or to the protected fauna and flora;
  • to respect a period of three years between two eco-burnings on the same plot;
  • to subsequently maintain the plot exhausted by a pastoral agricultural activity or useful for the environment and fire prevention.

Reminder: green waste (hedge trimming, lawn clippings, dead leaves, vegetable garden residue, etc.) is considered household waste in accordance with the law of August 3, 2009 implementing the Grenelle environmental framework.
The open burning of household waste is prohibited in accordance with article 84 of the Lozère departmental health regulations (RSD) approved by prefectural decree of October 25, 1979.

Any cut plant must be crushed, composted or sent to a suitable recycling center.
Only the burning of plants resulting from cutting residues from legal clearance obligations is authorized.if and only if the owner has not been able to opt for composting or shredding, in particular for questions of accessibility or volume.
