The US Congress did not violate the First Amendment of the Constitution by passing a law banning TikTok in the United States if the Chinese company ByteDance does not divest this popular platform by June 19. So decided the Supreme Court this Friday in an unsigned decision. The First Amendment to the Constitution notably guarantees freedom of expression.

“There is no doubt that, for more than 170 million Americans, TikTok provides a distinct and expansive means of expression, engagement, and source of communication. But Congress has determined that divestment is necessary to address its well-substantiated national security concerns about TikTok’s data collection practices and its dealings with a foreign adversary. For the foregoing reasons, we conclude that the challenged provisions do not violate Plaintiffs’ First Amendment rights,” the highest US court writes in affirming the ruling of the United States Court of Appeals for the District Circuit. of Columbia in this matter.

The law does not directly ban TikTok if ByteDance cannot or will not sell the app. However, it stipulates that application stores, such as those managed by Apple and Google, and cloud service providers, such as Oracle, cannot distribute the application. If they violate the law, these companies face fines of up to $5,000 per user with access to the app.

Donald Trump, who has already been in favor of banning TikTok, is reportedly considering signing an executive order on Monday allowing the platform to continue its operations in the United States. This decree could be the subject of legal action.
