A Grasse resident, father of two and divorced, says he has not been able to see them for three years despite court decisions in his favor. He has filed several complaints and is supported by the SOS Papa association.

After divorcing his partner, Nizar Al Fata says he hasn’t seen his children for “well 3 years”. Le Grassois has never been able to take care of his two children, even though the courts grant him one weekend per month and half of the school holidays.

“This is Ryan, he’s 13 and a half years old,” he says, pointing to photos hanging on the wall. “This is Clara, my daughter seen here, who recently turned 11.” These portraits are the only memories that the father keeps.

“I’m still in pain.”

“It must have been 3 years since I last saw them and 5 years since they came to my house,” he says. Separated from their mother, Nizar has not been able to exercise his visitation rights for months.

According to him, his ex-wife refuses to entrust him with their children despite court decisions in her favor. “I miss them every day, inside I am always in pain, in tears. Before I cried every day, physically I no longer have the strength to cry.”

The situation is also difficult for paternal grandparents. “I miss them a lot,” confides, very moved, Linda Al Fata. “I would like to see them.”

Multiple procedures

To be able to find them, the father, supported by the SOS Papa association, multiplies the procedures, in vain. Files which have not changed anything for the moment. “Complaints, judgments, handrails”, he lists in front of the file packages.

“I ask the justice system to do its job and ensure that enforceable judgments can be executed and that I can have my children,” he says.

In France, failure to present children is punishable by one year’s imprisonment and a fine of 15,000 euros.
