This Friday, November 15, 2024, is the fifth and final day of the trial of Gaël Scoubart and Lisa D. before the Côtes-d'Armor Assize Court, at the Saint-Brieuc courthouse. Eythan's stepfather and mother are on trial for the death of the little boy, 3 years old, in July 2022 in Guingamp.

The 32-year-old man is accused of murdering the child, his mother, 25, must answer for deprivation of care and failure to assist a person in danger.

Approximations, inconsistencies…

This Friday morning, the hearing resumed with the requisitions of the general advocate, Fabienne Basset. In the introduction, she explained that she was “convinced of the responsibility of the two accused in the death of Eythan, each at their own level”.

During a lengthy indictment lasting more than two hours, she first sought to demonstrate point by point the guilt of Gaël Scoubart, highlighting “its approximations, its inconsistencies” In « ses multiples versions. He is capable of remembering a lot of things and then having black holes.”

According to the representative of the public prosecutor, “the conditions for taking action are only met for Gaël Scoubart. It's undeniable, he was attached to Eythan, took care of him, but with his difficulties, his addictions. Faced with his own decline, with a situation of breakdown, he flees his responsibility, through a psychological barrier which prevents him from accepting his actions.

On the contrary, explained Fabienne Basset, of the child's mother. She asked the jurors to ask themselves this question: “What motive did she have for taking action? She was far from being as angry as Gaël Scoubart. »

Ten-year security period

However, the attorney general explained that she did not believe that Eythan's stepfather intended to kill. It was not for murder that she asked the jurors to convict him, but for intentional violence against a minor under the age of 15 leading to death without intention of causing it, a crime punishable by a maximum sentence of thirty years. of criminal imprisonment. On the other hand, according to her, the child's mother is indeed guilty of deprivation of care and failure to assist a person in danger.

In repression, Fabienne Basset requested sentences of twenty years of criminal imprisonment against Gaël Scoubart, with a security period of ten years, and five years in prison, including four years in prison, against Lisa D., with warrant deposit. The defense lawyers will now take the stand. The verdict is expected at the end of the day.
