The ICJ, located in The Hague, confirmed on Monday that it had received the document, via one of its officials, but refused to give further details.

“The evidence will show that Israel’s genocidal acts are based on the specific intention to commit genocide,” assures the South African presidency.

It highlights “Israel’s failure to prevent incitement to genocide, to prevent genocide itself, and failure to punish those who incite and commit acts of genocide.”

This “memorial”, which “cannot be made public” in accordance with the practices of the Court, contains more than 750 pages of argument and more than 4,000 in annexes, specifies the presidency.

Several countries have joined the proceedings brought by South Africa against Israel: Bolivia, Colombia, Libya, Spain and Mexico.

Although ICJ decisions are legally binding, the court has no concrete means to enforce them.

The Hamas attack on October 7, 2023 resulted in the deaths of 1,206 people, mostly civilians, according to an AFP count based on official Israeli data, including hostages killed or died in captivity. Of the 251 people kidnapped during the attack, 97 remain hostages in Gaza, 34 of whom were declared dead by the army.

According to the Hamas Ministry of Health, at least 43,020 Palestinians, mostly civilians, were killed in the Israeli offensive.
