A septuagenarian driver was sentenced this Monday, May 6, 2024 by the Pau court for involuntary manslaughter, to a six-month suspended prison sentence. On August 20, 2020, she knocked down a 74-year-old woman who was crossing at a protected crossing in Mazères-Lezons, the victim died three weeks later as a result of the accident. The victim was struck in the shopping area near the Brico Dépôt.

“I am not violent”

At the hearing, the victim’s husband and son spoke, very moved: “This accident is not a coincidence, it is a story of vigilance, of prudence.” The driver had not drunk alcohol or taken drugs before getting behind the wheel but she dragged the overturned woman six meters after hitting herin the parking lot of this commercial area, at a protected passage.

Before the Pau court, almost four years after the events, the defendant did not provide many answers about what happened: “I deeply regrets what happenedThat’s all I can say. […] I’m not violent, I didn’t think it could happen to me one day.” Her lawyer, Me Elodie Bedouret, added that her client still did not understand what happened and that she “did not seek to minimize“.

The court recognized inattention

To investigators, the driver declared that there was a large advertising panel which had prevented her from seeing the pedestrian arrive. In the eyes of the Pau public prosecutor’s office, “maximum vigilance is required in this environment, the driver who is paying attention stops, this vigilance was necessary when approaching the pedestrian crossing“.

According to the president of the court, in this case, the investigating judge estimated that this accident could have happened to many people. In addition to the suspended prison sentence, the Pau court also pronounced the cancellation of the driving license and the ban on ironing it for a month.
